Immigration detainer My brother got arrested for possession of paraphernalia and he has an INS detainer. He does have a criminal record of 2 felonies about 3 or 4 years ago, he also has a DUI and a driving on a suspended license. He stated that the pipe they found was the passengers and the passanger admitted to the cops that it was his, but they still charge him for it. Everyone I talk to tells me his case with the INS is not looking good because of his record, so I know we're going to have to hire an attorney but my family don't have a lot of money. Does any one know how much does an immigration attorney charges? |

As far as your brothers crimeal defence is that usaully they will award him a court appointed lawery as far as in immigration one you will have to call around because they have different price ranges. Good luck to you all,and may god be with you all as well as keeping your brother safe.

I do not have any good news for you. There is very little chance your brother will not be deported. You will be wasting your families resources to even attempt to keep him here. What you need would cost 10-15K.
He will not get an attorney for his immigration hold; and the public defender cannot help with that issue.
Even if the public defender get sthe current charges dismissed, he would be deported as he is not here legally ( or ICE would not have a hold on him).
It is becoming common for deportations to occur as routine in fedral court regardless whether they are found guilty or not. What will be worse, is that he is found guilty, does his time and then is deported.
You already know what will happen if he reenters befor ethe 20 year ban is over.
