The ninth Court of Appeals ruled against Arizona's immigration law! Would you like to comment on this ruling? |

Yes, it seems very strange to me to do so
These people are clearly illegal immigrants and should be treated as such and sent back to their own country
I live in Californian and we have many thousands of them. Taxpayers have to pay for their welfare, schooling medical etc, No wonder our state is bankrupt
I am the holder of a green card which I obtained legally and if people understood how difficult and traumatic the process, they would never support illegal immigrants
They are illegal, treat them as such

This shouldn't be anything surprising at all. Under the Fourth Amendment, regardless of citizenship since it pertains to anyone on our soil, people have the right to be safe from illegal search and seizure. Every person has the right to be secure in their persons, papers, effects and unreasonable search and seizure.
By requiring people to produce documents, this is, obviously, an infringement and intrusion on everyone's constitutional rights. I would refuse to show my papers, too.
Arizona's immigration law is/was unconstitutional. Period. If this law was allowed and accepted, there would be nothing preventing any form of government walking into people's homes and performing a "spot check". Not many people do not have a pirated movie or an illegal copy of a movie that they did not purchase (a Federal crime), illegally downloaded music (a Federal crime), and other sorts of things that amount to tens of thousands of dollars in fines and the possibility of time being spent in prison. Oh, let's not forget purchases from Amazon and not paying sales tax.
The Fourth Amendment protects everyone from these sorts of invasive searches. Arizona should feel ashamed and foolish. Arizona spent, and will probably continue to spend with an appeal, money that it doesn't have (by taking from the poor) trying to defend this unconstitutional, invasive, intrusive law.

The court ruled against the Arizona's immigration law and called it unconstitutional because it interfered with the Fed's authority over immigration.
It's just my opinion personally, but government is getting too big for it's britches. Naturally, the decision was welcomed by immigration activists.
The law proposed that police officers would be able to check the immigration status of anyone they had in custody or suspected may be illegal.
The appellate court decided that the law meddled with federal issues due to provisions in the law which required immigrants to carry papers at all times and banning those without the proper paperwork from working in a public place.
Republican Governor Jan Brewer signed the law in April of 2010 and had wide support for the law in the state. The law was opposed by Obama and civil rights groups. Obama argued that the U.S Constitution gives the FED total authority over immigration decisions.
